The Founder of MegaUpload,Kim Dotcom, May Get Seized Property Back After Procedural Error

Remember in January, Kim Dotcom, founder of Megaupload, got arrested and received a 50 year sentence?
Now, the authorities in New Zealand announced that there has been a procedural error prior to confiscating the property of Kim Dotcom. He might be able to reclaim his $17.8 million worth of seized assets, and $6.8 million in frozen cash.(Pictures Below)

Kim Dotcom’s assets were seized with the wrong kind of court order, and the judge declared the order that was used in the seizure as, “null and void,” which meaning, no legal effect.

Judge: you can’t sue family members over unwanted facebook photos.

Let’s face it. We all have photos of ourselves that we wish it was never ever taken. Everyone of us deals with these situations in a different manner, especially on Facebook. Some of us simply untag ourselves, request it to be taken down, delete it, or report it.

However, Aaron Olson, from Chisago City, Minn, takes it to a brand new level. He sued his uncle, Randall LaBrie for harassment, due to a a childhood picture of Aaron himself.

Aaron requested the photos to be removed or edited, so his image won’t be visible in the photo. Randall, acknowledging Aaron’s request, he only removed the tag, and told Aaron that he should stay off Facebook if he doesn’t like the photo.

So Aaron fights back, with a lawsuit.
After going through the court, the Judge stated, “to constitute harassment, words must have a substantial adverse effect on the safety, security, or privacy of another. Comments that are mean and disrespectful, coupled with innocuous family photos, do not affect a person’s safety, security, or privacy — and certainly not substantially so.”

In other words, You can’t file a lawsuit against your family members just because they posted embarrassing pictures of you on Facebook.

Did Aaron take things too far? Or should law protect us from things like that too?

Facebook did a good job connecting old friends, coworkers together. But Facebook also made a lot of people’s lives more miserable. People getting fired for posting stupid status on Facebook, seeing your ex’s pictures and seeing how happy they are with their life now, and..lawsuits too.
I actually think technology advancements and lawsuits go hand in hand. Before Apple had its huge success, we would still hear about lawsuits, but not as much as now. Patent lawsuits filing everywhere across the world.

Loopholes For Drinking Driving

First I must say, DO NOT DRINK AND DRIVE, NEVER.

I was debating to post this or not, as the information should be pretty darn sensitive. I guess I just need to post the whole story here:

A RCMP officer(Monty Robinson) is being charged of obstructing justice- he left the scene of a data motorcycle accident and drank 2 shots of vodka to so-called “calm his nerves”.

Robinson was one of four officers that taser-ed Robert Dziekanski, (whom was later announced dead) at Vancouver International Airport,

Robinson’s lawyer, David Crossin, argued that the officer that arrested Robinson at the accident scene’s testimonies shouldn’t be taken into consideration because Robinson wasn’t notified of his right to legal counsel, before telling her about vodka.

Anyhow, here is the main point of this post:

In the court case, the Crown prosecutor stated that, Robinson is using his police training to get away with convictions- especially when he claimed to have consumed alcohol after the accident.

Prosecutor’s witnesses indicate that Robinson went through RCMP training courses in 2005, and he was taught that those who consumed alcohol and drove, can had their impaired charge dismissed, if they had drank more between the time of the accident and the time they got caught.

On top of that, he was also taught that, as long as they left their driver licenses behind at the accident scene, they may be dismissed from a charge of fleeing from the scene of a crash too.

Don’t ever ever ever Drink and Drive-as it is deadly dangerous and can ruin families within seconds.

So, according to RCMP data training courses:

If you are pulled over by the police after drinking and driving. Stop the car and drink more liquor right away. An impaired driving charge could possibly dismissed.

If you see a roadblock ahead of you and you drank before, pull over, leave the car, and call car towing companies. Getting your car towed is way better than being criminally charged. They will find you afterwards, but thats afterwards.

If you had an unfortunate accident after drinking, you can also leave your driver licenses at the scene, that can possibly dismiss you from a charge of fleeing from an accident.

Anyhow, these information are only for knowledge use, and to acknowledge the loopholes in our justice system only.
